Terms and Conditions

VACATION RENTAL POLICIES

CHECK - IN

  • Check-in time is after 3:00 PM - This allows the cleaning crew ample time to clean thoroughly.
  • Upon checking in, please ensure that the property is cleaned and in good condition.  Immediately notify Bay Pointe Property Management of any damage to ensure you are not charged upon departure.    

CHECK - OUT 
  • Check-out time is before 10:00 AM
  • Leave all dirty linens on the laundry room floor
  • Place all dirty dishes in the dishwasher and start the cycle
  • Lock all sliding glass doors, windows and standard doors
  • Turn off all lights
  • Lock the front door
 
CANCELLATIONS | (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Bay Pointe Property Management agrees to refund the full amount paid to the date of cancellation, and Guest agrees to release any claims against Bay Pointe Property Management and/or Owner.  (b) If, for any reason, the Guest cancels this Agreement more than sixty (60) days from the Arrival Date, Guest will receive a refund of amounts paid, less a $100 + applicable 11% tax cancellation fee. For Guest cancellations made 59 days or less, all monies are forfeited unless Bay Pointe Property Management is able to re-rent the Property under the same (or better) terms and conditions of this Agreement, for the full Term reserved. If the Property is re-rented under the same (or better) terms and conditions than this Agreement, Bay Pointe Property Management will refund amounts paid, less a Cancellation Fee of $100.00 + applicable 11% tax. (c) There are no cancellations permitted within 30 days of Guest Arrival Date. All amounts paid (Reservation Deposit and Final Payment) will be forfeited. Failure to pay the Final Payment in a timely manner will be considered a cancellation under this sub paragraph and will result in forfeiture of the Reservation deposit.

SECURITY DEPOSIT | Guest agrees to deposit a sum (between $400.00 - $2,000, depending on property and length of stay) as a security deposit for the faithful performance of all covenants, conditions, and agreements to this contract. Bay Pointe Property Management and/or Owner may use, apply, or retain the whole or any part of this security deposit to the extent required for the payment of any default of this rental agreement by guest. The use and application thereof by Bay Pointe Property Management or Owner shall at all times be discretionary.  In the event that guest shall comply with all terms of this agreement, and surrenders the property promptly in the condition required by this agreement, the security deposit shall be returned to guest within thirty (30) days after the premises has been vacated and inspected by Bay Pointe Property Management.  No interest shall accrue to guest on any such deposit.  The security deposit shall not, under any circumstances, be applied by guest for payment of any part of rent.  

RENTERS INSURANCE | Guest is strongly encouraged to secure the appropriate travelers or vacation insurance and/or renter’s insurance.

FALSE RESERVATIONS | Any and all reservations made under false pretense will forfeit any and all funds already received by Bay Pointe Property Management.  Guest will not be allowed or entitled to check - in to the property.  This includes exceeding the number of persons stated on the rental agreement.  

CASUALTY OR DESTRUCTION
 | (a) Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, hurricanes, storms, floods or fires), or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest. (b) Should the Property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Guest and Bay Pointe Property Management based on the following: No refund is due (or will be made) for bad weather. Guest and parties listed above must comply with any mandatory evacuation order.

DAMAGE, REPAIR, AND MISSING ITEMS | Any intentional damage, theft, unauthorized pets, extensive cleaning required at check-out, smoking, exceeding occupancy or parking limits,and any other charges/policies in Rental Policies and Rental Agreement including any fines imposed on Bay Pointe Property Management by the City, County, State or Home Owner Association as the result of violation of any law, ordinance, rule or regulation or any fines or cost levied against Guest or visitors of Guest (“Excess Damage Costs”), to the Rental Property and its contents. Guest will be notified of any Excess Damage Costs in writing.

Repair and maintenance problems must be brought to Bay Pointe Property Management's attention as soon as such problems are discovered, or Guest will be held liable for all such damages or repairs. There will be no rebates or refunds issued to Guest for any reason as every good faith effort is made to insure the property is maintained to highest standards.

All keys must be returned upon checkout. There will be a charge of $25 for lost or unreturned keys.

SMOKING | All of our properties are NON - SMOKING, no exceptions. 

HOUSEKEEPING | Properties will be cleaned before and after all occupants.  Cleaning fee is for departure cleaning only and does not include daily maid services.  Towels, linens, blankets, etc. are included in all properties, please do not remove these items from the unit (You will be charged for ALL missing items).    

PETS | No pets are allowed unless you receive written permission prior to final payment. An additional non-refundable pet fee is required on those properties that do permit pets. 

LOCKOUTS | Please call Steve Boge at 239.994.2229, 24 hours a day, for all lockouts.  A $50.00 fee will be charged for after hours lockouts. Business hours are 8 AM - 6 PM.  

UTILITIES | No compensation will be given for temporary outages of electricity, gas, cable, telephone, or water service.  The operation of these utilities is out of the control of Bay Pointe Property Management.  All outages should be reported to Bay Pointe Property Management immediately.  

INDEMNIFICATION | Guest agrees to indemnify and hold harmless Bay Pointe Property Management and the owner of the Property against all loss, damage, expense, and penalty arising from any action of the Guest or visitors of the Guest which causes injury or death to any person or damage to any property.  Guest agrees to defend, indemnify and hold Bay Pointe Property Management and owner harmless from any and all liability, claims, loss, property damage or expenses, arising by reason of any injury, death or damage sustained by any person, or to the property of any person, in or on the Property,  including Guest, additional invitees or visitors of Guest, where such injury, death or damage is caused by a negligent or intentional act of Guest, additional guest or any of Guest’s visitors or invitees.

SWIMMING POOL / SPA | Use of the swimming pool is at your own risk. All guests assume the risks of use and waive the right to file suit against the owner or Bay Pointe Property Management for any loss, damage, injury or liability that should occur. No diving is allowed. The guest assumes all responsibility for themselves and anyone that they allow to be in the pool area. There is no lifeguard on duty.

FURNISHINGS | Bay Pointe Property Management’s vacation rentals are individually and privately owned.  Please do not rearrange the furniture in the unit, take any interior decorations outside, move any furnishings or decorative items to another unit.
